Terms and Conditions of Use

These Terms and Conditions (“Agreement”) set forth the general terms and conditions of your use of the Octovis Automated Property Management System (“Platform”) offered by Octovis Sdn. Bhd. (“Octovis”, “we”, “our” or “us”). By registering for, accessing or using the Platform and related services, you agree to be bound by the terms set out below. If you do not agree to these Terms, please refrain from using the Platform.

1. Definitions

  • “Platform” refers to the Octovis property management software, inclusive of its web and mobile versions.
  • “User” or “you” refers to the individual or business entity that has registered to use the Platform.
  • “Account” means the personalised portal registered to access the Platform features.
  • “Services” means all functions offered within the Platform including but not limited to tenancy billing, rent collection, document generation, integration modules, and analytics dashboards.

2. Account Registration and Eligibility

  • Users must be at least 18 years old to register for an Account.
  • Each User must provide accurate, current and complete registration information.
  • Octovis reserves the right to suspend or terminate any Account found to be misleading, fraudulent or duplicated.

3. Scope of Services

  • The Platform provides Users with an integrated solution to manage tenancy agreements, automate invoicing, track rental payments, and monitor property portfolios.
  • Features include but are not limited to: payment gateway integration, digital contract storage, smart device linkage, tenant reminders, and reporting modules.

4. User Responsibilities

  • You agree to keep your login credentials secure and confidential at all times.
  • You are solely responsible for all activities conducted under your Account.
  • You shall promptly update all personal or business information provided to ensure accuracy.

5. Acceptable Use

  • You agree not to misuse the Platform or engage in unauthorised access or interference with any part of the system.
  • You shall not distribute malware, engage in phishing, or disrupt other Users’ access.
  • Use of the Platform must comply with all applicable laws and regulations of Malaysia.

6. Subscription and Payment Terms

  • Users are required to select a subscription plan and pay the corresponding fees to access premium features.
  • All payments are to be made in advance, are non-refundable and non-transferable.
  • Octovis reserves the right to revise pricing plans with prior notice.

7. Maintenance, Upgrades and Availability

  • Octovis will take reasonable measures to maintain system availability at 99.9%, excluding scheduled downtime and force majeure.
  • We may perform maintenance or implement upgrades that may temporarily affect service accessibility.
  • Users will be notified in advance for all scheduled major maintenance.

8. Intellectual Property Rights

  • All intellectual property rights in the Platform and its content are owned by or licensed to Octovis.
  • You shall not duplicate, copy, modify, distribute, or reverse engineer any part of the Platform without our prior written consent.

9. Suspension and Termination

  • Octovis reserves the right to suspend or permanently disable any Account that violates these Terms or abuses the Platform.
  • Upon termination, all user data may be retained or deleted in accordance with our data retention policies.

10. Limitation of Liability

  • Octovis shall not be held liable for any indirect, incidental, special, or consequential damages resulting from your use or inability to use the Platform.
  • Our total liability under these Terms shall not exceed the total fees paid by you in the past six (6) months.

11. Indemnity

  • You agree to indemnify and hold harmless Octovis, its affiliates and staff from all losses, damages, claims and liabilities resulting from your breach of these Terms or misuse of the Platform.

12. Governing Law and Dispute Resolution

Any disputes shall first be attempted to be resolved amicably, failing which, it shall be submitted to the courts of Malaysia.

These Terms shall be governed by and construed in accordance with the laws of Malaysia.
